Terms and conditions

1. DEFINITION AND SCOPE OF CONTRACT
1.1. This agreement ("agreement") is a contract according to art. 50 et seq of legislative decree September 6, 2005, n. 206 ("consumer code"). The contract for the sale of products Siciliando s.r.l. via Bresciana Km 1, 91022 Castelvetrano (TP) and the consumer (the "customer"). The contract is concluded directly through your acceptance of Siciliando srl of a purchase proposal issued by the customer via the internet, following the invitation to offer content on the web site www.siciliando.eu (the "site"), on the basis of the procedures described in section 3.
1.2. These general conditions of sale ("terms and conditions") and, in particular, the information provided for in art. 52 of the consumer code, as provided by Siciliando srl and site, will remain valid and enforceable until they are modified and/or supplemented by Siciliando srl. Any changes and/or additions to the terms and conditions will be effective from the date on which will be communicated to the public and will apply to sales made after that date. The latest updated version of the general terms and conditions is available on the site.

2. PRICES
2.1. The selling prices of the products shown on the site are inclusive of incl. and all other taxes. Delivery charges are indicated on the site and may vary based on weight and volume of individual packages.

3. METHOD OF PURCHASE AND PAYMENT
3.1. Purchases of products available as illustrated and described online in the datasheets, shall be carried out by the customer at the current price indicated, inclusive of incl., to be confirmed at the time of placing the order, plus the shipping costs and still appear at the moment of purchase. Functions and features are described in the data sheets are provided by the manufacturer. Siciliando srl declines any responsibility for any changes or inaccuracies. Photos used for product sheets, while reflecting the main characteristics, may differ for color or for some details.
3.2. Before confirming the purchase, you will be shown the unit cost of each product chosen, the total order line, the total cost of the order when purchasing multiple products and transportation expenses.
3.3. The customer, confirming the acceptance of your purchase order you will receive an e-mail message. If the customer does not receive any confirmation, the purchase order is deemed to be cancelled.
3.4. The customer will be allowed to choose one of the payment methods that will be clearly listed within the site and they will be regarded as valid by Siciliando srl for the PURPOSES of PRODUCT WARRANTY (as per law of 24 months), the order confirmation sent by HOUSE MONTALBANO SRL the closing of PURCHASE by the CUSTOMER. For online sales, assimilated for VAT at mail order, has waived the CERTIFICATION REQUIREMENT. Such sales are not subject to the obligation of invoice, unless requested by the client when ordering (only SUBJECTS with VAT number) and are also exempted from certification through the receipt or cash receipt (article 22 of the P.r.decree # 633/1972) under article. 2 of P.r.decree December 21, 1996, # 696.

4. DELIVERY OF PRODUCTS – CLAIMS
4.1. Siciliando srl shall deliver the products to the address indicated by the customer within 30 (thirty) days after the conclusion of the contract, as expected by the consumer code; in the case of orders with bank transfer, products are delivered within 30 working days with effect from receipt of order total to our Bank.
4.2. The customer must verify, upon receipt, the product delivered to him with the order; the customer must sign the delivery note stating "subject to verification on wholesomeness of products"; If this does not happen, the customer cannot oppose any dispute about the appearance of what was handed to him and its compliance with the order.
4.3. Any complaint will be forwarded to the following address: Siciliando s.r.l. via Bresciana Km 1, 91022 Castelvetrano (TP).
4.4. The delivery of the goods takes place "EX WAREHOUSE vendor". The clause "ex warehouse seller" inserted in the contract, means that the goods must be delivered to the customer/purchaser or his delegate (eg. forwarder) at the warehouse of the seller. All expenses incurred in transporting the goods the buyer, as well as its risks.

5. AVAILABILITY OF PRODUCTS.
5.1. Siciliando s.r.l. accepts customer orders within the limits of the quantities of products requested exist in stock. Therefore, the acceptance by Siciliando s.r.l. of the purchase proposal forwarded by the customer is subject to the availability in stock of the products themselves. Siciliando s.r.l. undertakes to inform the customer of any unforeseen breakdowns of stocks due to excess demand or other causes.

6. GUARANTEES AND ASSISTANCE
6.1. Products purchased through Siciliando s.r.l. are protected by the rights guaranteed by the laws currently in force. This warranty only applies to faults occurring despite the normal use of the product, i.e. in respect of its functionality and as provided in the technical documentation, in compliance with the various operating rules listed above. The product warranty does not apply in the case of negligence, carelessness in the use, maintenance or in connection to electrical systems or otherwise non-compliant. The guarantee is personal and will apply only to the original purchaser. Before returning the product under warranty, you will be notified by email the return authorization number (RMA), which must be indicated on the carton of the product, which must be shipped together with the sales/purchase order document to Siciliando s.r.l. via Bresciana Km 1, 91022 Castelvetrano (TP). Siciliando s.r.l. will reject any returned product not packaged or incomplete, as well as products for which have not been already paid by customer return postage. In the event of a reinstatement of a product with a new or replacement, the warranty starts anyway from the purchase of the first product. Siciliando s.r.l. is not responsible, nor in respect of third parties against the customer, nor for any damages or losses than it sold and incurred for manufacturing defects. Under the terms of the warranty, these responsibilities are the sole responsibility of the manufacturer.

7. OBLIGATIONS OF THE CUSTOMER
7.1. You represent and warrant:

  • being a consumer in accordance with art. 3 of the consumer code;
  • He is of age;
  • that the data from the same provided for performance of the contract are correct and true.

8. RIGHT OF WITHDRAWAL
8.1. Sales of goods via the Internet are governed by Legislative Decree n. 206/05 (articles 50 to 68) which regulates the matter of distance contracts, i.e. carried out outside business premises. This legislation establishes the right of withdrawal, or the ability for the consumer to return the product purchased and the reimbursement of expenditure incurred. This right is reserved exclusively to natural persons (consumers) and can not be exercised by legal persons and natural persons acting for purposes relating to their professional activity. To exercise the right of withdrawal must be sent within 10 working days from receipt of goods, a communication is clearly manifested the intention to withdraw from the contract. The notification shall be made by registered A/R as required by law. In accordance with article 55, second paragraph, of the code of consumption, the customer has no right of withdrawal in the following cases: · supply of audiovisual products or software which were unsealed by the customer; supplying products tailored or customized, or due to their nature, cannot be returned or are liable to deteriorate or expire rapidly (i.e. groceries, cosmetics, flowers, etc.); · supply of newspapers, periodicals, magazines. The costs of returning the product are charged to the customer.
The right of withdrawal is lost if the product is not returned intact, namely:

  • in the absence of elements of the product (accessories, cables, manuals etc);
  • for damage to the product for reasons other than transportation.

8.2. Simultaneously with the dispatch of A registered letter please communicate your decision via email to customer support (siciliandosrl@gmail.com). Within three working days you will receive your return authorization number (RMA) that will identify your practice. At the time of submission of the package you will need to indicate on the packaging the return authorization number attributed by Siciliando s.r.l.. The costs of returning products are charged to the customer. Siciliando s.r.l. will return within 30 days of receipt of the goods by the customer:

  • the full price paid by the customer (excluding the value attributed to the expedition in the sales phase) when returning the product complete with all its parts and features;
  • the part of the price equivalent to actual product returned by the customer who has consumed the product appreciably and/or to diminish significantly the value.
